1. Scope of this policy

This policy applies to information collected through the public website at pccguru.com, including demonstration requests, business inquiries, and SMS/Texting enrollment and messaging administration.

PCC GURU also processes information for customer organizations through the PCC GURU software platform. Processing of customer data, including resident information obtained through authorized PointClickCare Data Relay services, is governed by applicable customer agreements, business associate agreements, security requirements, and customer instructions. This public website policy does not replace those agreements.

The public contact form is not intended for resident information, protected health information, or urgent clinical matters. Please do not submit such information through the website contact form.

2. Information we collect

Information you provide through the website

When you request a demonstration or contact PCC GURU, we may collect your name, organization, title or position, work email address, telephone number, number of facilities, and the information included in your message.

SMS/Texting enrollment information

When the PCC GURU SMS enrollment program is active, we may collect and maintain:

• Your PointClickCare username, which includes an organization identifier.
• The mobile telephone number you submit for enrollment.
• Confirmation that the submitted number matches the number in your PointClickCare User Profile.
• The date, time, method, and version of the disclosure associated with your consent.
• Your consent status, opt-out status, and number-change history.
• SMS delivery, failure, HELP, STOP, START/UNSTOP, and future acknowledgement records.
• Technical and security information reasonably needed to administer the program.

Your PointClickCare password is used only to perform authentication during the enrollment process. PCC GURU does not store your PointClickCare password as part of the SMS consent record.

Technical information

Our web server may automatically record standard technical information such as Internet Protocol address, browser type, device information, requested pages, date and time, referring page, and security or error logs. We use this information to operate, secure, troubleshoot, and improve the website.

The public website uses a temporary first-party session cookie to support form security, including CSRF protection and submission-rate controls. PCC GURU does not use the public website to place third-party advertising cookies.

3. How we use information

PCC GURU may use information to:

• Respond to demonstration requests, questions, and business inquiries.
• Communicate about PCC GURU software and services requested by you or your organization.
• Authenticate authorized users and verify SMS enrollment information.
• Deliver operational and clinical-review alerts requested by participating organizations and opted-in users.
• Administer consent, number changes, HELP requests, STOP requests, suppression, delivery status, and future acknowledgement workflows.
• Maintain security, prevent fraud or misuse, diagnose technical problems, and protect PCC GURU, customers, users, and others.
• Comply with applicable law, regulation, contractual obligations, and lawful requests.
• Maintain records reasonably necessary to demonstrate consent and honor opt-out requests.

4. SMS/Texting privacy and program information

Program purpose

PCC GURU Text Alerts are intended for authorized staff members of participating skilled nursing and long-term-care organizations. Messages may notify recipients of selected operational or clinical-review events generated by PCC GURU using organization-defined criteria. The program is not a marketing-message program.

Consent and verification

SMS consent is associated with the combination of the participating organization, authenticated PointClickCare username, and verified mobile number. The user-entered number must match the mobile number maintained in the user’s PointClickCare User Profile. If the profile number changes, a new opt-in is required before PCC GURU will send messages to the new number.

Message frequency and charges

Message frequency varies and may range from no messages to multiple messages per day, depending on facility activity, the alert categories enabled by the participating organization, the number of facilities for which the recipient is authorized, and the number of qualifying events. Message and data rates may apply according to the recipient’s mobile plan. PCC GURU does not charge a separate fee to the recipient for receiving SMS alerts.

Opt-out and help

Reply STOP to end all PCC GURU text messages to that mobile number. A STOP request is treated as a global PCC GURU SMS opt-out for that number, across organizations, usernames, facilities, and alert categories. Email delivery may continue where applicable.

No marketing sharing

We do not sell or rent mobile numbers, SMS consent records, or opt-in information. We do not share mobile information with third parties or affiliates for their marketing or promotional purposes.

5. How information may be disclosed

PCC GURU may disclose information in the following limited circumstances:

• Service providers: To hosting, security, email, telecommunications, and other vendors that process information on our behalf to provide or protect the requested services. These providers are not authorized by PCC GURU to use mobile opt-in information for their own marketing or promotional purposes.
• Participating organizations: To the customer organization associated with the user where reasonably necessary to administer authorization, alert delivery, consent, or support.
• Legal and safety reasons: When reasonably necessary to comply with law, regulation, legal process, or governmental request, or to protect rights, security, users, customers, or the public.
• Business transition: In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to applicable confidentiality and legal requirements.
• With your direction or consent: When you direct us to disclose information or otherwise consent.

6. Security and retention

PCC GURU uses administrative, technical, and physical safeguards designed to protect information appropriate to its nature and sensitivity. Planned SMS controls include encrypted storage of mobile numbers, secure number matching, consent and suppression records, authentication before detailed alert access, and access checks based on facility permissions.

No Internet transmission, mobile network, or electronic storage method is guaranteed to be completely secure. Recipients should protect their mobile devices, avoid forwarding sensitive alerts, and report a lost device or unauthorized access to their organization and PCC GURU where appropriate.

We retain information for as long as reasonably needed to provide services, respond to inquiries, maintain business and security records, establish consent, honor opt-outs, resolve disputes, and comply with legal or contractual obligations. Opt-out and suppression records may be retained to prevent future unwanted messages.

7. Your choices

• You may choose not to submit the demonstration-request form and instead contact PCC GURU directly.
• SMS enrollment is optional and separate from email delivery.
• You may reply STOP to discontinue all PCC GURU SMS messages to your mobile number.
• You may contact PCC GURU to request reasonable access, correction, or deletion of information, subject to applicable legal, contractual, security, and record-retention requirements.
• If your mobile number changes, you must update your PointClickCare User Profile and complete a new PCC GURU SMS opt-in for the new number.

8. Changes to this policy

We may update this Privacy Policy from time to time. The effective date at the top of the page identifies the current version. Material changes to the SMS/Texting program may also be communicated through the website, enrollment process, or other appropriate means.
