1. Public website and customer agreements

This website describes PCC GURU software and services and allows visitors to request information or a demonstration. It does not itself create a customer relationship, software subscription, business associate relationship, or obligation to provide services.

Any PCC GURU subscription, implementation, Data Relay processing, support service, or other customer service is governed by the applicable written agreement. If these Website Terms conflict with a signed customer agreement, the signed agreement controls for the services covered by that agreement.

2. Permitted use

You may use the public website for lawful business and informational purposes. You agree not to:

• Attempt to gain unauthorized access to the website, PCC GURU systems, customer data, user accounts, or security controls.
• Interfere with website operation, introduce malicious code, scrape the site excessively, or use automated means that burden or damage the service.
• Misrepresent your identity, organization, authorization, or purpose.
• Submit resident information, protected health information, illegal content, or confidential information through the public contact form.
• Copy, reproduce, distribute, reverse engineer, or exploit website content or product demonstrations except as permitted by law or written authorization.

3. Product descriptions and availability

PCC GURU may revise reports, dashboards, alerting capabilities, pricing, service descriptions, implementation requirements, and website content. The reports listed on the website are representative examples and are only a subset of available PCC GURU reporting capabilities.

The published subscription price of $99 per facility per month, with no per-user or per-bed fees, describes the standard PCC GURU software subscription as presented on the website. Applicable Data Relay arrangements, implementation requirements, professional services, taxes, customer-specific terms, and other charges or conditions may be addressed in a proposal or written agreement.

Organizations may begin with one or two facilities and expand later, subject to applicable agreements and implementation requirements.

4. No medical, clinical, legal, or reimbursement advice

PCC GURU reports and alerts organize and identify information for review by authorized and qualified personnel. PCC GURU does not diagnose residents, prescribe or discontinue treatment, determine whether a medication or service is clinically appropriate, direct resident care, or replace professional judgment.

Reimbursement-related reports may identify documented changes that could warrant MDS or Interim Payment Assessment review. PCC GURU does not decide that an IPA must be submitted, determine the correct MDS response, or guarantee approval, payment, increased reimbursement, compliance, or survey outcomes.

Organizations and their qualified personnel remain responsible for reviewing source documentation, making clinical and operational decisions, submitting regulatory information, and complying with applicable law, regulation, professional standards, and payer requirements.

5. Intellectual property

The website, PCC GURU name and branding, software descriptions, report layouts, demonstrations, text, graphics, and other content are owned by PCC GURU LLC or used with permission and are protected by applicable intellectual-property laws.

Except for ordinary website viewing and internal evaluation of PCC GURU services, no rights are granted to reproduce, modify, distribute, publicly display, create derivative works from, or commercially use website content without written permission.

6. PointClickCare and third-party services

PCC GURU is an independent software and services company. PointClickCare is a trademark of its respective owner. PCC GURU is not represented as PointClickCare or as an official PointClickCare product.

Website references to PointClickCare, Data Relay, mobile carriers, telecommunications providers, or other third-party products and services are provided to describe interoperability or business context. Third-party products and services are governed by their own terms, privacy policies, availability, and requirements.

Links to third-party websites are provided for convenience. PCC GURU does not control and is not responsible for third-party sites or content.

7. Demonstration requests and communications

Submitting a demonstration request authorizes PCC GURU to use the information provided to respond to the inquiry. Submission does not enroll the visitor in the PCC GURU operational SMS alert program and does not constitute consent to receive marketing text messages.

Please use accurate business contact information and do not include resident information or protected health information in the contact form.

8. SMS/Texting program

The PCC GURU SMS/Texting program is governed by the separate SMS Terms and Conditions and Privacy Policy. Authorized users must complete the applicable opt-in process before receiving PCC GURU text alerts.

9. Disclaimer of warranties

To the maximum extent permitted by law, the public website and its content are provided “as is” and “as available.” PCC GURU disclaims warranties regarding uninterrupted operation, accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, or results obtained from use of the website.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, PCC GURU LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the public website, reliance on website content, or interaction with third-party services.

Nothing in these Terms limits liability that cannot lawfully be limited. Customer-service liability, if any, is governed by the applicable written customer agreement rather than these public Website Terms.

11. Governing law

Unless a separate written agreement provides otherwise, these Website Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute concerning the public website will be brought in a court of competent jurisdiction serving Palm Beach County, Florida, except where applicable law requires otherwise.

12. Changes to these Terms

PCC GURU may update these Terms from time to time. The effective date at the top identifies the current version. Continued use of the website after an update constitutes acceptance of the revised Terms.
